• Your drafts and play sessions are private. Nothing is shared until you publish it.
• Publishing releases a permanent version of your creation under the HoloArcade Community License v2. Published versions cannot be taken back.
• You may play published simulations, and build with community characters and worlds where their creator allows reuse.
• External use of another user's work requires their explicit permission.
• Use HoloArcade legally, respectfully, and responsibly.
• Naughty Mode marks adult (R-rated) content. Erotica is tolerated there, and only there.
• Our AI can be wrong, biased, or inconsistent.
• Coins are a virtual currency used to pay for AI tasks.
• We may update these terms (we'll notify you).

1. Accepting These Terms

By creating an account or using HoloArcade, you agree to:

If you don't agree, please stop using the service.

Minimum age:

• 18 years old
• HoloArcade is restricted to adults. If you are under 18, you are not permitted to create an account or use the Services.

2. Your Account

Creating an Account

You may sign up using email/password or an OAuth provider.

You are responsible for:

• Keeping credentials secure
• All actions on your account
• Letting us know about unauthorized access

Account Security Rules

• Don't share your password
• Don't let others use your account
• Use a strong password
• Log out when you're done

We may suspend or terminate accounts that violate our rules.

3. Content Ownership & Rights

3.1 Your Drafts and Play Sessions Are Private

The worlds, characters, and simulations you build are private drafts: only you can see and edit them, and they stay private for as long as you like. Your play sessions and conversations with AI characters are private too, and creators of published simulations never get access to them.

You retain full ownership and commercial rights to your AI-generated content, to the maximum extent legally available for AI-generated works.

3.2 Publishing to the Community

Sharing happens through publishing: a deliberate act with its own consent dialog. Publishing releases an immutable version of your creation under the HoloArcade Community License v2. The essentials:

• Publishing is permanent. Published versions cannot be unpublished or taken back — like an open-source release. You can always publish improved versions; older ones stay available and existing save games keep the version they were started on.
• Play and reuse are separate grants. Publishing a simulation lets everyone play it. Letting others build with your character or world in their own simulations is a separate, opt-in grant you make by publishing it from its own builder.
• You keep credit ("by @yourhandle") and can hide your name at any time without withdrawing the content. If you delete your account, your name is permanently removed from your published versions, but the versions remain.
• Community publishing is unpaid. You are owed no compensation for community-licensed versions, now or later (see the license for details, including how possible future creator monetization would work).
• Only we can remove published content, and only for moderation, legal, or data-protection reasons (see "How Moderation Works" below).

3.3 Platform-Provided Assets

HoloArcade owns all platform-created assets (character images, backgrounds, etc.).

We release these to you under the HoloArcade Community License v2.

4. Content Rules

4.1 General Restrictions

You may not use HoloArcade to:

• Create illegal, harmful, or abusive content
• Impersonate others or create fake identities
• Harass, threaten, or harm users
• Upload malware or malicious code
• Hack, exploit, or abuse the platform
• Violate intellectual property rights
• Bypass rate limits or automate access

Violations may result in suspension or termination.

4.2 Minors: an Absolute Rule

• Characters under 18 may only exist in creations where Naughty Mode is off. Fictional families and children are welcome there, like in any novel or film.
• A Naughty Mode creation may never include a character who is under 18, appears to be under 18, or is presented as under 18. There are no exceptions: no species, lore, or lifespan arithmetic changes this.
• Any sexual or suggestive content involving minors is strictly prohibited and leads to immediate termination.

4.3 Naughty Mode

Naughty Mode marks a world, character or simulation as made for adults, comparable to an R-rated movie or a PEGI 18 rating. Erotic content is tolerated only inside Naughty Mode creations, as part of a story. A creation that is mostly erotica is not allowed, even with Naughty Mode enabled.

Outside Naughty Mode, stories contain no erotic content. Romance is always welcome in every mode: flirting, falling in love, kissing, and relationships are part of storytelling and are not tied to Naughty Mode.

Naughty Mode creations are always clearly labeled, and enabling or playing them requires an account with a stored birthdate of at least 18 years plus a one-time adult confirmation.

4.4 Generated Imagery

• Images and videos never depict sexual acts, in any mode.
• Genitals are never shown, in any mode. Characters always wear at least underwear bottoms.
• In Naughty Mode, images may show a bare upper body. Outside Naughty Mode, the upper chest stays covered as well: swimwear, lingerie or underwear is fine, bare is not.
• Poses come from a curated list that contains no sexual poses, and every generated image shows a single character.
• Public imagery (character sheets, preview images, everything shown in Explore) always stays safe for work.

4.5 Built for Safety

HoloArcade has no prompt inputs and no uploads: worlds and characters are assembled from curated lists, so the AI is never handed free text or outside material. This makes deepfakes of real people structurally impossible and prevents whole categories of abuse before they can happen. Names and labels are screened, a consent analyzer accompanies every interaction, and published content is reviewed by human moderators when reported (see "How Moderation Works" below).

Reporting Content

Content that other users publish (such as forum messages and publicly listed simulations) can be reported directly where you encounter it — via the flag/report button on the content itself. If you believe content is illegal, choose the "Illegal content" reason and explain why. You will receive a confirmation that we got your report and, after review, an email with the outcome. Logged-out visitors can report content by emailing support@holoarcade.ai with a link to the content (see the Legal Notice).

How Moderation Works

• Reports are reviewed by a human moderator — we do not use automated systems to remove published content. (AI guardrails that steer content during generation are a safety feature, not content moderation.)
• Depending on the outcome, we may remove content, restrict features, or temporarily or permanently suspend an account.
• When we remove your content or restrict your account, we send you a statement of reasons by email: the decision, the ground (illegal content or the Terms clause violated), and the facts it was based on.
• Appeals: if you disagree with a moderation decision — as the affected user or as the reporter — open a support ticket on your Tickets page and reference the decision email; a human will re-review it.
• Submitting repeated, manifestly unfounded reports is itself a misuse of the reporting system and may lead to moderation action.

5. AI-Generated Content Guidelines

• AI output may contain errors or biases
• AI may repeat styles, patterns, or produce similar content for different users
• AI characters are not real people, they are simulated agents
• Always review AI-generated content before sharing publicly

6. Coins & Payments

What Are Coins?

Coins are a virtual currency that exists only within HoloArcade. Coins are used to:

• Generate AI content (text, images, audio, video)

Purchases, Withdrawal & Refunds

When you buy a coin package, delivery begins immediately: the coins are credited to your account as soon as your payment is confirmed. At checkout you expressly consent to this immediate performance and acknowledge that you lose your statutory right of withdrawal once you start spending the coins.

• As a consumer in the EU you may withdraw from a coin purchase within 14 days of buying it, as long as the package is fully unused. To withdraw, email support@holoarcade.ai with your order reference — no reason needed. We will refund you via your original payment method within 14 days of your request.
• Once you spend any coin from a package, your right of withdrawal for that package lapses (per your consent at checkout) and the package becomes non-refundable.
• Coins are non-transferable
• Coins have no cash value

If an AI generation fails, coins used during that action are returned.

7. Feature Changes

We may:

• Add features
• Modify features
• Deprecate features (with notice)
• Change AI models or providers

Significant changes affecting paid features will be announced.

Trademarks

"HoloArcade" and related branding, including branding used for our own simulations, characters, worlds, locations are our trademarks.

10. Disclaimers

HoloArcade is provided "as-is", without warranties of:

• Accuracy
• Reliability
• Fitness for a particular purpose
• Uninterrupted service

We are not responsible for:

• User disputes
• User content
• How you use AI-generated output

11. Indemnification

You agree to indemnify and hold HoloArcade harmless from claims arising from:

• Your content
• Your behavior
• Your violation of these terms
• Your infringement on others' rights

12. Termination

By You

You may delete your account (including your personal data) anytime.

• Deletion is permanent (cache retention up to 60 days)
• Unused coins are forfeited
• Versions you published under the Community License are not deleted — the community's rights to them are irrevocable. Your name is permanently removed from them instead (see the Community License).

By Us

We may suspend or terminate your account if you:

• Break the rules
• Create legal or security risks
• Abuse the service

Severe violations may trigger immediate termination.

13. Governing Law & Dispute Resolution

Most issues can be resolved informally.

Governing Law

These terms are governed by the laws of the Grand Duchy of Luxembourg, where HoloArcade S.à r.l.-S is established (see the Legal Notice for company details).

If you are a consumer in the EU/EEA, this choice of law does not deprive you of the protection of the mandatory consumer-protection rules of your country of residence, and you may bring proceedings before the courts of that country.

We may update these terms for:

Continuing to use HoloArcade means you accept updated terms.

15. General Provisions

• These terms form the entire agreement
• If a section is unenforceable, the rest still applies
• Our failure to enforce terms doesn't waive our rights
• We may assign these terms during a merger or acquisition
• We're not liable for events beyond our control
